A resolution between the Denver and Rio Grande Western Railroad Company and the city of Steamboat Springs (CO) whereas the railroad company allows the city to construct a pedestrian and bicycle rail, portions of which will encroach and cross the railroad’s right-of-way. The city pays the railroad a set fee to remove and replace tracks at locations of trail underpass, as well as for the insurance protections for all railroad staff and activity in the area. The city is responsible for all costs and maintenance of the trail, including a fence required by the railroad. The railroad is indemnified from any damages and can take possession of the trail within thirty days’ notice. Either party can terminate the agreement at any time.
